In response to recent scandals surrounding the NEET and UGC-NET exams, the Indian government has implemented stringent measures aimed at preventing paper leaks and cheating during public examinations. The newly introduced Public Examinations (Prevention of Unfair Means) Act, 2024, issued by the Ministry Of Personnel, Public Grievances and Pensions, seeks to safeguard the integrity of these crucial assessments that impact the futures of countless students nationwide.
The law includes several key provisions to crack down on exam malpractice. Individuals caught using unfair means during exams face severe penalties, including imprisonment for a minimum of three years, extendable to five years, and fines reaching up to Rs 10 lakh. Moreover, those unable to pay fines may face prolonged jail terms.
Testing agencies, labeled as “service providers” under the law, are also held accountable. They could incur fines up to Rs 1 crore and be required to cover a proportionate examination cost. Furthermore, if found complicit in facilitating cheating, these agencies may be barred from conducting any public exams for up to four years.
Senior management officials implicated in exam irregularities are subject to even stricter consequences, including imprisonment ranging from three to ten years and fines up to Rs 1 crore.
The law provides exemptions in cases where individuals can prove their innocence and demonstrate efforts to prevent wrongdoing. However, those involved in organized cheating activities face severe penalties, including imprisonment ranging from five to ten years and fines starting at Rs 1 crore.
The NEET and UGC-NET exams, crucial for admission into medical and academic courses, have recently faced significant challenges. The NEET exam, taken by approximately 24 lakh aspirants in May, was tainted by allegations of paper leaks in Bihar. Similarly, the UGC-NET exam was canceled due to the dissemination of its question paper on illicit online platforms prior to the exam.
These incidents have sparked widespread outrage and protests among students and parents, prompting swift legislative action from the government. The enactment of the Public Examinations (Prevention of Unfair Means) Act, 2024, underscores the government’s commitment to ensuring the fair and transparent conduct of public examinations.
This legislative move is aimed at restoring confidence in the examination system and maintaining trust among students and stakeholders. By enforcing stricter penalties and accountability measures, the government aims to deter exam malpractice and uphold the credibility of India’s educational assessments.
